RUTHERFORD CHILD CUSTODY CASE HAS UNUSUAL TWIST

Lansing parents may know that actress Kelly Rutherford has spoken out regarding the unusual and complicated situation that she now finds herself in with ex-husband Daniel Giersch. According to reports, Giersch, who lives abroad, has had his U.S. visa revoked for unknown reasons. As a result, he is no longer able to travel to the United States. In light of this, the children were visiting him for the summer overseas when, unfortunately for Rutherford, a judge ordered that custody of them be awarded to the father. This international child custody case has sparked intense media interest.

Rutherford has stated her concern for the children, and says she is unsure of their father’s stability. In addition, the children are United States citizens now being ordered to live in another country, which has caused quite an outpouring of opinion in the media. Though Rutherford continues to object to the judge’s decision, Giersch states that he is focused on the children and continues to promote Rutherford having as much contact with the children as possible.

The children were scheduled to start school in New York, though the judge’s decision has changed those plans. That is not to say, however, that the children cannot find such routine with their father in France. Rutherford is working with lawyers to appeal the judge’s decision but so far the order stands. She says that she travels to France as often as possible, but it is challenging with her work schedules and responsibilities.

It is not uncommon for divorced parents to choose to live in other states, or other countries, from their ex-spouse and children. In most cases, however, there is a carefully managed plan regarding child custody arrangements. Lansing parents who find that the other parent of their children is relocating elsewhere may benefit from the careful consideration of all of the relevant facts and circumstances, regardless of either parents’ personal preference or feelings toward the other. If the parties cannot reach an agreement, a judge will necessarily determine what the court believes to be the best interests of the children.
